The judge said that Musk's statements were aspirational and puffery, not factual claims and thus no reasonable investor would rely on them. In 2022 investors accused Musk of using his Twitter following and an appearance on Saturday Night Live to influence the meme coins price and allegedly take profits on his suspected holdings at their expense. And Ryan Salem, the former FTX executive who was sentenced to 7.5 years in prison has withdrawn a legal request asking that the conditions of his plea deal be enforced or that his plea be thrown out and his sentence vacated. Last week. Salem's lawyers filed a petition stating that prosecutors obtained his guilty plea improperly getting him to agree to a guilty plea by promising that they would cease their investigations into Michelle Bond. Salem's longtime partner, Judge Lewis Kaplan ruled he would still hold a hearing on the original petition regardless of Salem's motion to withdraw bond. A former US SEC lawyer was indicted in federal court for taking illegal campaign contributions from Salem and other FTX employees during her failed 2022 run for a congressional seat.
